New Hampshire Second Injury Fund update

NEW HAMPSHIRE SECOND INJURY FUND UPDATE

On February 23, 2023, the New Hampshire House of Representatives introduced Bill HB-2, which, among many other things, has called for the elimination of the Second Injury Fund in New Hampshire. The Second Injury Fund, created under RSA 281-A:54, provides reimbursement to employers and insurance carriers for compensation paid to employees with pre-existing permanent physical or mental impairments who are injured in the course of their employment.

Under the proposed Bill, employers and insurers will be unable to seek reimbursement for subsequent, or second, injuries that occur after September 1, 2024.

This Bill has been referred to the House Committee on Finance, which held a public hearing on March 13, 2023. Additional committee hearings will be scheduled in the coming weeks.

Patrick Jamison

Attorney Patrick Jamison joined TKCK in March 2023. He has been practicing Workers’ Compensation law exclusively for 10 years.

Patrick grew up in Albuquerque, New Mexico and attended the University of Texas at Dallas, earning his undergraduate degree in Political Science. While there, he dedicated much of his spare time to his position as captain of the university’s mock trial team.

Patrick attended Suffolk University Law School, focusing his studies on trial and appellate advocacy. Patrick was the winner of Suffolk’s individual Mock Trial Competition.

Patrick has worked primarily on the defense side of workers’ compensation, but also has experience representing employees, as well as the Massachusetts Worker’s Compensation Trust Fund. During his time with the Trust Fund, Patrick played a key role in helping establish precedent for the Department of Industrial Accidents’ exclusive jurisdiction over Workers’ Compensation cases with the Massachusetts Appeals Court in Merchants Insurance Group v. Kevin Spicer, 88 Mass. App. Ct. 262 (2015).

He is admitted to practice in both the federal and state courts of Massachusetts.
